1. Acceptance of Terms
By accessing or using this website, you agree to be bound by these Terms & Conditions and all applicable laws. If you do not agree, you must discontinue use of this website.
These Terms apply to website use only. All videography services are governed separately by a signed service agreement between the Client and Golden Daze Films.
2. Services
Golden Daze Films provides professional videography services, including but not limited to
• Milestone events (birthdays, graduations, celebrations)
• Church, school, club, and nonprofit promotional videos
• Small business promotional and introductory videos
• Personal family films and lifestyle documentation
Services may be provided in California or anywhere within the United States, subject to availability and written agreement.
A booking is not confirmed until a written contract is signed and any required deposit is received.
3. Creative Control
Client acknowledges that videography is a creative service involving artistic discretion. Final editing decisions, music selection (unless otherwise agreed), color grading, pacing, and overall style are determined by the Company.
Two (2) minor revision requests may be allowed as specified in the signed agreement. Raw footage is not included unless expressly stated in writing in our contract after final payment.
4. Intellectual Property & Usage Rights
All videos, footage, edits, graphics, and content created by Golden Daze Films remain the intellectual property of the Company unless otherwise specified in a written agreement.
Clients are granted a non-transferable, non-exclusive license for personal use or agreed promotional use as defined in the service contract.
Clients may not:
• Resell footage
• Re-edit footage
• Transfer usage rights to third parties
• Use content for commercial resale without written permission
5. Portfolio & Promotional Rights
Unless otherwise agreed in writing prior to filming, the Company reserves the right to use portions of completed projects for:
• Portfolio display
• Website content
• Social media
• Promotional and marketing materials
If a client requires confidentiality or restricted usage (common for private family films or minors), such restrictions must be agreed to in writing before the event date.
6. Client Responsibility & Releases
Client is responsible for obtaining any necessary permissions, location permits, or third-party consents required for filming.
For events involving minors (schools, churches, youth programs, etc.), Client represents that appropriate parental or guardian consent has been obtained where required.
The Company is not responsible for claims arising from failure to secure required permissions.
7. Travel & Out-of-State Services
For services performed outside California, additional travel, lodging, and related expenses may apply as specified in the service agreement.
Client is responsible for ensuring compliance with venue rules and local regulations.
8. Force Majeure
The Company shall not be liable for failure to perform due to circumstances beyond reasonable control, including but not limited to:
• Severe weather
• Natural disasters
• Illness or injury
• Equipment failure despite reasonable maintenance
• Government restrictions
• Venue restrictions
In such cases, remedies are limited to rescheduling or refund as outlined in the signed service agreement.
9. Disclaimer
Website content is provided for informational purposes only. While we strive for accuracy, no guarantees are made regarding completeness or availability.
Videography results may vary based on lighting conditions, venue limitations, participant cooperation, and environmental factors.
10. Limitation of Liability
To the fullest extent permitted under California law, Golden Daze Films shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from:
• Use of this website
• Performance or non-performance of services
• Loss of footage due to technical malfunction beyond reasonable control
Total liability shall not exceed the total amount paid under the applicable service agreement.
11. Indemnification
Client agrees to indemnify and hold harmless Golden Daze Films from any claims, damages, liabilities, or expenses arising from:
• Client’s failure to obtain required permissions
• Venue or third-party claims
• Misuse of delivered content
12. Governing Law & Dispute Resolution
These Terms and any disputes arising from services shall be governed by the laws of the State of California.
Any dispute not resolved informally shall be resolved in the courts located in Orange County, California.
Each party shall bear its own attorney’s fees unless otherwise required by law or specified in a signed agreement.
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
14. Modifications
We reserve the right to update these Terms at any time. Updates will be posted on this page with a revised date.
